An assault is the act of inflicting physical harm or unwanted physical contact upon a person or, in some specific legal definitions, a threat or attempt to commit such an action. It is both a crime and a tort and, therefore, may result in either criminal and/or civil liability. Generally, the common law definition is the same in criminal and tort law.
Traditionally, common law legal systems had separate definitions for assault and battery. When this distinction is observed, battery refers to the actual bodily contact, whereas assault refers to a credible threat or attempt to cause battery. Some jurisdictions combined the two offences into assault and battery, which then became widely referred to as “assault”. The result is that in many of these jurisdictions, assault has taken on a definition that is more in line with the traditional definition of battery. The legal systems of civil law and Scots law have never distinguished assault from battery.
Legal systems generally acknowledge that assaults can vary greatly in severity. In the United States, an assault can be charged as either a misdemeanor or a felony. In England and Wales and Australia, it can be charged as either common assault, assault occasioning actual bodily harm (ABH) or grievous bodily harm (GBH). Canada also has a three-tier system: assault, assault causing bodily harm and aggravated assault. Separate charges typically exist for sexual assaults, affray and assaulting a police officer. Assault may overlap with an attempted crime; for example an assault may be charged as an attempted murder if it was done with intent to kill.

A model who appeared in the 2010 “Teenage Dream” music video has accused Katy Perry of sexual misconduct during an event the two attended several years ago.

In an Instagram post, Josh Kloss said the star humiliated him when she approached him at a party around 2012 for Johnny Wujek, a former creative consultant for America’s Next Top Model. Kloss said Perry “pulled my Adidas sweats and underwear out as far as she could to show a couple of her guy friends and the crowd around us, my penis.”

After the alleged incident, Kloss said he felt “pathetic and embarrassed.”

Representatives for Perry, Kloss, and Wujek didn’t immediately respond to BuzzFeed News’ requests for comment.

Kloss’s decision to tell his story comes just days after Perry celebrated the ninth anniversary of her album Teenage Dream, which cemented her as one of the world’s top pop stars.

“Was actually gonna play the song and sing it on [ukulele] for the anniversary, but then as I was tuning I thought, fuck this, I’m not helping her bs image another second,” Kloss said.

The model said that during filming for the 2010 video Perry was “cool and kind,” but also told everyone on set that kissing him was “gross.”

“I was pretty embarrassed but kept giving my all,” he said.

Around two years later at Wujek’s party, Kloss said, he still had a “crush” on Perry but felt belittled when she allegedly exposed his genitals.

He said he decided to tell his story “because our culture is set on proving men of power are perverse. But females with power are just as disgusting,” he said.

In subsequent posts about the matter, Kloss said power, not gender, is a determining factor in abuse. “You hear over and over a million times that Males are the great evil on this planet. Meanwhile you know the truth POWER empowers what is corrupt in people, regardless of their gender,” he wrote.

And in his Instagram profile bio, he seemed to anticipate questions from people who might ask why it had taken him so long to speak out after appearing in the music video in 2010: “Why 9 years? Read some comments,” he wrote. “I tried to take it to the grave to protect her AND myself. But the issue is bigger than us, so TRUTH be told.”

But Wujek, whose party Perry and Kloss attended, and others have come to the singer’s defense.

“I’m not about to let you make accusations against my friend like this,” Wujek said on Instagram. “This is such bullshit. Katy would never do something like that.”

The stylist said Kloss has an “ongoing obsession” with Perry and that he’d be “praying” for him.

Jewelry designer Markus Molinari, also a good friend of Perry’s, hit back at Kloss, calling him a liar.

“Remember you texted me saying how you’re in love with her and you wrote her a song? And how soon you’ll be able to flying anywhere to meet her,” Molinari wrote on Instagram in a comment reply to Kloss. “You were paid for a job like any other job you’ve had but your obsession with Katy has hit another level. Stop lying to yourself and find peace ✌🏻 in your life. Move on.”

In addition to saying Perry sexually assaulted him, Kloss said he was “lorded over” by the American Idol judge’s representatives, who he said told him not to discuss “a single thing about anything regarding Katy publicly.”

“So, happy anniversary to one of the most confusing, assaulting, and belittling jobs I’ve ever done,” Kloss said.
